Terms of Service

1. The platform
Flexhand AG ("Flexhand", "we", "us") operates a digital workforce platform at flexhand.ch that connects production operators with Swiss pharmaceutical, chemical and logistics manufacturers. The platform provides operator profile hosting, certificate verification, shift posting, application management and a gamified work-record system. Flexhand is a technology service provider and labour-leasing intermediary; it is not the employer of record for any engagement arranged through the platform.
2. Eligibility
You must be at least 18 years old and legally permitted to work in Switzerland to register as an operator. Employers must be a validly registered Swiss or EU/EFTA company. By creating an account you represent that you meet these requirements.
3. Accounts and security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify Flexhand immediately at ops@flexhand.ch if you suspect unauthorised use. Operators warrant that all information submitted — including certificates, work history and identity documents — is accurate and genuine. Misrepresentation may result in immediate removal from the platform and may have legal consequences under Swiss law.
4. Operator profile and verification
Flexhand reviews operator submissions against uploaded documentation and, where applicable, contacts issuing authorities before publishing a profile. Verification is a reasonable-effort check and does not transfer the employer's own due-diligence obligations under Swiss labour, pharmaceutical or chemical regulations. An unverified profile is not visible in the public directory. Flexhand reserves the right to revoke verification at any time if new information comes to light.
5. Employer KYB
Employers must pass a Know Your Business review before they may post shifts. This review confirms legal incorporation and contact details. Flexhand may request supporting documents and may revoke employer access at any time for cause.
6. Shifts and engagements
Shift postings and applications create a commercial relationship directly between operator and employer. Flexhand facilitates the introduction but is not a party to the individual employment contract. Rates shown are set by the posting employer. Flexhand does not guarantee any minimum volume of work. Premium surcharges apply to night, weekend and extraordinary shifts as displayed at the time of posting.
7. Fees
The platform is free for operators. Employers pay a margin on top of the agreed operator rate, invoiced separately under the applicable service agreement. All fees are quoted exclusive of Swiss VAT (MWST) where applicable.
8. Acceptable use
You may not use the platform for fraudulent, discriminatory or unlawful purposes. You may not scrape, reverse-engineer or redistribute platform data without written consent. Employers may not circumvent the platform to directly hire operators sourced through Flexhand during the term and for six months after, except with Flexhand's written agreement.
9. Intellectual property
All platform software, design, content and trademarks belong to Flexhand AG. Your work records and personal data remain yours. You grant Flexhand a limited licence to display your profile in the operator directory and in shortlist communications with employers.
10. Liability
The platform is provided "as is". To the extent permitted by Swiss law, Flexhand AG excludes liability for indirect or consequential loss, loss of profit, loss of data, or any claim arising from an employment relationship between an operator and employer. Flexhand's total aggregate liability in contract, tort or otherwise shall not exceed the amount paid by the claiming party to Flexhand in the six months preceding the event.
11. Termination
Either party may close their account at any time. Flexhand may suspend or terminate accounts for breach of these terms, fraud, or if required by law. On closure, your personal data is handled as described in the Privacy Policy.
12. Governing law and jurisdiction
These terms are governed exclusively by Swiss law (to the exclusion of the Vienna Sales Convention). Disputes shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of Flexhand AG, Switzerland.
13. Changes
Flexhand may update these terms with 30 days' notice by email or in-app notification. Continued use of the platform after the effective date constitutes acceptance. If you do not accept the updated terms, you may close your account.
